Friday, April 17, 1998 H-E-B sues IRS SAN ANTONIO (AP) -- H-E-B Food Stores has filed a federal lawsuit
against the Internal Revenue Service claiming the grocery company
is owed an overdue tax refund of $1.3 million. H-E-B filed the lawsuit Wednesday claiming it overpaid its
1991 and 1992 taxes. The lawsuit seeks the refund along with interest
and costs under the Internal Revenue Code. H-E-B contends it filed timely income tax returns and paid
almost $19.4 million for the 1991 tax year and $25.3 million for
1992. The grocery company said it then made four more payments to
the IRS that totaled $1.87 million for 1991 and $679,441 for 1992
after the IRS examined the returns and asked the company to make
"adjustments." However, H-E-B claims it overpaid. Last June, the grocery company filed claims seeking a refund
for the two tax years, but the IRS dismissed those claims, according
to the lawsuit. The company asked again for the refund in March,
but the IRS has not responded. H-E-B Food Stores is based in San Antonio. It operates grocery
stores throughout Central and South Texas.
