Attorney General settles nursing home suit, files another

AUSTIN (AP) - Attorney General Dan Morales announced a lawsuit against one nursing home and a settlement with another in which he said conditions were unsafe and unhealthy for residents.

Morales is seeking civil penalties in a lawsuit against Crestview Manor Retirement and Convalescent Center in Waco alleging patients there were neglected.

The attorney general obtained a $25,000 settlement in a lawsuit filed in 1994 against the Texarkana Nursing Center, where the attorney general said patients were alleged to be in danger of life-threatening conditions as a result of neglect.

The settlement with Britwell Investments II Inc., doing business as Texarkana Nursing Center, was filed Monday in state district court in Travis County. Britwell, which did not admit guilt in the settlement, sold the nursing center to Unison, of Scottsdale, Ariz., in 1995.

Texarkana Nursing Center administrator Don Henry, who has been with the company for less than a year, did not have a comment on the settlement.

The new lawsuit was filed in state district court in McLennan County against Marwitz Brothers Inc., doing business as Crestview Manor. It seeks civil penalties of up to $10,000 per violation and per day of violation.

Scott Marwitz, President of Marwitz Brothers, Inc., said he was unaware of the suit and had no comment.

The lawsuit alleges that patients were neglected and found unbathed, bruised, with malodorous, infected open wounds, unchanged diapers, and lying in beds soaked with urine and crusted and smeared with feces.

Patients were also found with dirty and blocked feeding tubes and dirty urinary drainage tubes, and soaked wound dressings.
